Our Mompreneur ‘Two Scents’: It is not always the best route to patent your idea right away. Talk to an experienced IP attorney that works with start-ups. Ask their confidence level in patenting your product. All your communication with them is confidential and a good one WON’T CHARGE YOU for an initial Q&A. You should only consider spending the money;

  1. If you really have a revolutionary new technology or process, created from scratch, that with or without a physical product is still valuable.
  2. You are planning to go to market fast in a new consumer category and want the power of “patent pending” on your package. It does peak the interest of consumers.

Just make sure you are not spending the money on a patent only to scare off competitors. Honestly, the most successful concepts don’t have any competition when they start out anyway.

Determine your business model ahead of time and understand the value of branding and trademarks, watch our vlog for more info. They can be even more valuable than a patent. Whatever you do, don’t let the worry of being copied paralyze you! Until you prove to the big guys that there is lots (like millions) to be made with your idea, they are going to stick with what they are doing that’s already making them money. Plus, most of them are too big and scared to do anything very fast anyway.
